Within the framework of the Privacy Policy presented to you, we discuss your rights, obligations and rules related to the use of the Service and our processing of your personal data.

§1
Definitions

At the outset, we will provide you with the definitions with which you need to be familiar in order to be able to fully understand the meaning of the terms we will use in this document.

  1. External Service – these are the websites of our partners, service providers or service recipients who cooperate with us as Service Administrator/Data Store Administrator
  2. Administrator of the Website or Administrator – we mean the entrepreneur conducting business activity under the name TAX LEGAL PARTNER J. Włoch, P.Szot spółka jawna with registered office in Kraków (30-644), ul. Puszkarska 7M/601, Building H, entered into the register of entrepreneurs of the National Court Register by the District Court for Kraków – Śródmieście in Kraków XI Economic Division of the National Court Register under number 0001005801, NIP: 6751774484, REGON 523806600
  3. Service – it means the website operated by the Administrator
  4. User – means a natural person (i.e. it shall not be, for example, a limited liability company), for whom we, as the Administrator, provide services electronically using our Website
  5. Cookies – are text data which are usually collected automatically in the form of text files stored on your Device (i.e. the User)
  6. Newsletter – a service consisting of providing you with content about our company, available products, promotions, advertising actions, blog posts, etc.
  7. GDPR – an act of common law in Poland with the full name Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU. L. of 2016 No. 119, p. 1 as amended).
  8. Personal data – here we will provide you with the full definition under the GDPR. It is therefore any information about an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of the natural person
  9. Processing – again, we will use the definition derived from the GDPR. This is because it is an operation or set of operations which is performed upon personal data or sets of personal data, whether or not by automated means, such as collection, recording, organisation, organisation, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction
  10. Restriction of processing – means the marking of stored personal data for the purpose of restricting its future processing;
  11. Profiling – means any form of automated processing of personal data which involves the use of personal data to evaluate certain personal factors of an individual, in particular to analyse or predict aspects relating to that individual’s performance, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements;
  12. Consent – of a data subject means a freely given, specific, informed and unambiguous demonstration of will by which the data subject, by means of a statement or a clear affirmative action, consents to the processing of personal data concerning him/her;
  13. Personal Data Breach – means a breach of security leading to the accidental or unlawful destruction, loss, modification, unauthorised disclosure of or unauthorised access to personal data transmitted, stored or otherwise processed;
  14. Processor – means a natural or legal person, public authority, entity or other body that processes personal data on behalf of the Administrator;
  15. Psedonymisation – means the processing of personal data in such a way that they can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is stored separately and is covered by technical and organisational measures that make it impossible to attribute it to an identified or identifiable natural person;
  16. Anonymisation – under this process, we carry out a complete, irreversible process of operations on personal data, whereby they are destroyed or overwritten, thus making it impossible to identify or link the occurring record to a specific User (including you).

Cookies used by us (Administrator) and Cookies of Third Party Services

As part of our Service, Cookies may be placed and read from your (User’s) Device. These are mostly placed automatically on your Device.

Cookies can be divided into:

  1. Internal Cookies – files placed and read from the User’s Device by the Service’s data communications system.
  2. External cookies – files placed and read from the User’s Device by tele-information systems of external Services. The scripts of external Services which may place Cookies on User Devices have been deliberately placed on the Website through scripts and services made available and installed on the Website
  3. Session Cookies – files placed and read from the User’s Device by the Website during a single session of a given Device. At the end of the session, the files are deleted from the User Device.
  4. Persistent cookies – files placed and read from the User Device by the Website until they are manually deleted. The files are not deleted automatically after the end of a session of the Device, unless the configuration of the User Device is set to delete cookies after the end of a session of the Device.

Ways and purposes of processing your Personal Data

The personal data voluntarily provided to us by you (the User) are processed for one of the following purposes:

  1. Provision of electronic services, i.e. the Newsletter service (in case you agree to receive it)
  2. b) Our communication with you (the User) on matters related to the functioning of the Service or the protection of your personal data
  3. To contact you by means of electronic communication and traditional forms of contact (e.g. by post)
  4. Ensuring our legitimate interest (of the Administrator), which may be understood as, but is not limited to, keeping relevant accounting documents related to the provision of services to you.

Your personal data may be transferred outside the European Union as a result of, among other things, your individual action (e.g. making a comment or posting on our Blog), thus making it available to any visitor to our Service.

Your data will not be sold by us to third parties.

Your data for our marketing purposes will only be processed with your consent. This can be given by you by filling in a form to receive commercial information by electronic means (newsletter) or by ticking the appropriate box next to the contact form. This consent may be withdrawn at any time without prejudice to the services we provide to you. Furthermore, revoking this consent will not affect the correctness of the data processing. Your consent to data processing for marketing purposes does not affect your use of our Service.

Your rights

In accordance with the GDPR, with regard to your (User’s) personal data processed by us (the Administrator), you have:

  1. The right to access your personal data and to be issued with a copy;
  2. Correction of your personal data
  3. Deletion of your personal data
  4. Restriction of the processing of your personal data
  5. Portability of your personal data

Remember that you can always object to the processing of personal data concerning you. To the extent that we use your personal data for direct marketing purposes, you can withdraw the consent you have given us at any time. If you wish to exercise your right, all you need to do is email us at kontakt@taxlegalpartner.pl and specify the scope of your request.

We will respond to your message promptly, but no later than 72 hours after your request. However, we reserve the right to be able to verify your identity for the purpose of processing this request. You may, in this case, be asked to send a scan of your identity card or passport or the bill on which your details appear. However, you need not be concerned. The data submitted to us are not entered into any personal data file. Once the verification process is completed, they are immediately deleted by us.

This kind of action is necessary for us to protect your vital interests in accordance with Article 6(1)(d) of the GDPR

If you believe that, in relation to your personal data, we, as Administrator, are processing it contrary to data protection legislation, you are entitled to lodge an appropriate complaint with the supervisory authority having jurisdiction over your place of residence, place of business or place of alleged infringement.

On what basis do we process your data

Personal data collected as part of our Service is processed on the basis of

    1. Article 6(1)(a) GDPR – i.e. when you consent to the processing of that personal data for one or more purposes (e.g. performance of the Agreement and marketing consent)
    2. Article 6(1)(b) GDPR – i.e. when the processing is necessary for us to perform a Contract to which you are a party (e.g. the provision of our services to you)
    3. Article 6(1)(c) GDPR – i.e. when the processing is necessary for us to fulfil our legal obligations (e.g. obligation to keep accounting records for tax purposes)
    4. Article 6(1)(f) GDPR – that is, when the processing of your data is necessary for us out of legitimate legal interests pursued by us (the Administrator) or a third party (e.g. processing a complaint).

How long we process your personal data

Depending on the type of personal data, it may be stored for:

  1. 30 days – in case you unsubscribe from the Newsletter;
  2. 3 years – in case you violate or are suspected of violating the Terms and Conditions;
  3. As a general rule – 5 years after the tax payment deadline – in the case of personal data which is processed for the purpose of keeping tax records.

Who may also have access to your personal data

As a rule, the recipient of the personal data you provide is us (the Administrator). The data is not transferred or resold to third parties.

However, on the basis of a data entrustment agreement, your personal data may also be accessed by entities responsible for the maintenance of our infrastructure or provision of services necessary for the operation of the Website, i.e:

  1. The hosting company – i.e. the entity that provides hosting or related services to us in order to maintain the Website
  2. Companies through which we deliver our Newsletter to you
  3. Companies that act as intermediaries for online payments made when you purchase our Products when you purchase them using our Service
  4. Companies that are responsible for our bookkeeping, including providing us with bookkeeping and tax record services
  5. Companies that are responsible for the delivery of our Products to you (the User).

Entrusting the processing of personal data for the provision of the Newsletter service

In order to provide our Newsletter service we use the service of FreshMail sp. z o.o.

Entrusting the processing of personal data in order to obtain the Hosting, VPS service

In order for us to provide our Service, we use a third-party hosting provider, VPS. Any data we collect and process on the Service is stored and processed on the infrastructure of one of our service providers, which is located within the borders of the European Union.  The personal data processed by us may be accessed by the aforementioned entities as a result of maintenance work carried out by the staff of the service provider. The access of this data is regulated within the framework of the contract in force between us and these entities.

Transfer of personal data in the case of accounting services

We enter some of your data into our accounting system or transfer it to the entity providing accounting services for us. The provision of such data is primarily the result of a contractual relationship between us and the accounting service provider or accounting software service provider.
